Separate current operation from the unresolved lawsuit

WDE says the Wyoming Supreme Court lifted the lower-court injunction, allowing the program to proceed and payouts to be made while the broader constitutional lawsuit continues in district court. WDE also says future legal outcomes cannot be predicted. Record the date checked and do not present current operation as a final ruling on the lawsuit.

Do not turn the 2025–26 rule into a general reimbursement promise

WDE says the lifting of the injunction is not retroactive and full prior-year costs cannot be reimbursed. It describes a limited fourth-quarter payment of $1,750 that may roll into 2026–27 for students who were previously approved and were not enrolled in public school for 2025–26. Verify the student’s status with WDE instead of assuming an old expense qualifies.

Follow the current 2026–27 application path

WDE says previously approved families complete the 2026–27 application and may see prior information prepopulated for confirmation or correction. First-time families are directed to the family handbook from the current program page. A prepopulated application is not the same as approval of a student, provider, service, or purchase.

The WDE page supports the dated program, litigation, application, and limited rollover statements; it does not predict the lawsuit or approve a particular family, provider, service, or expense. Any checklist or comparison record on this page is original SEH editorial material, not an official form, legal opinion, validated assessment, funding decision, provider verification, or outcome guarantee. Official checks before you act

Because homeschool law, special education services, and funding rules vary, verify requirements with your state education department, local district, official ESA or scholarship program, and qualified providers. Keep screenshots or PDFs of official guidance with your records.

Frequently asked questions

Is the Wyoming ESA program currently operating?

WDE says the injunction has been lifted and the program may proceed while the constitutional case continues. Recheck the WDE page because the litigation and program instructions can change.

Can every 2025–26 expense be reimbursed now?

No. WDE expressly says full prior-year costs cannot be reimbursed and describes only a limited fourth-quarter rollover for specified previously approved students. Verify the student and expense directly.

Does a current application or provider listing guarantee payment?

No. Verify eligibility, provider status, the exact expense, required documentation, and the payment route with WDE before committing money.
